Palm Hills Juristic Person (Moo Baan)

The residents and plot Owners at Palm Hills have initiated the process of forming a Juristic Person (Moo Baan) under Thai legislation.

To achieve this status 51% of plot owners and residents need to vote in favour of forming their own Juristic Person.

If you are a resident or plot owner or know someone who is then please complete the attached ballot form and return to ph.members@yahoo.com

Hi Malcolm,
What 51% is needed?
a) 51% of plot owners
b) 51% of residents, therefore incl. each condo owner?
c) 51% of the whole area?

We have just bought in Palm Hills. Is there any information available on the advantages
/disadvantages of setting up a juristic person. Would there be additional costs such as having to rent an office there etc etc. For example we just had a problem with an overhanging tree, we called The office and it was fixed the next day. Would something like this still be dine by Palm hills people or would the juristic person have to hire separate gardeners.

Think about it seriously if you are satisfied right now. If you like institutionalization you might be in favor of it, maybe not if you aren’t. It puts a lot of power in the hands of a few people. Somtimes people push for it because they want to take power away from a present group that they are unhappy with. But after it is approved you are saddled with it

It is a hard question to answer. 1) There is a current water shortage in Palm Hills. Lakes are drying up. Estimated that 1 month supply to drinking water is remaining. Cha AM can only give two hour of water at night. Quotes are out for other connection possibilities. New pipes will have to connect this to the treatment plant. 2) The cost of repairing roads is expensive. The roads are in need of repair. My guess is there are 20km of roads to upkeep. 3) Cost of equipment to maintain the property is expensive. 4) All of this cost money. When you consider the current cost, it is reasonable compared to other association fees. IMHO If we take over, what happens if we then have to increase charges to cover all of the cost? What will be the repercussions of this possibility? Everyone is not paying and never will. For owners who have been there for many years, they believe the cost increase is not justified. But before was so cheap, it could not have covered the cost of maintenance. again IMHO I would appreciate additional thoughts and conversation about this. I am a new Plot Owner and have not cast a vote either way at this point.

This is the update I received from Palm Hills regarding water supply: Cha Am has already been contacted, they do not have enough water for us - -only 5,000 m3 for their production capacity and their pressure also not enough. Anyhow, we are now digging pond at front of the project as recommended by the Mayor- -to stock water supply from pipe line and install pump for pumping up to our plant inside. (We can get volume of water during night time or around 130 m3 for 2 hrs.) Other way, we are now waiting for process of Petchburi Irrigation for direct connect their under ground pipe line that they sent to Palace and Hua Hin. Another 15 days for their answer and quotation.

I have to agree with Sunandfun, I'm not prepared to blindly vote for something without first having seen the relevant information to enable me to make an informed decision. If there is a business plan and projected financial statements for the proposed new juristic person then maybe the OP can point us in the direction of where to obtain it.

The application was rejected last year
