and most importantly

Well of course I am a bit too cynical here (I hope).
Cynical or not Roel you are of course right - that the parents might convince the judge that they will curb the kid themselves. My hope in all this is that a case being brought by Thammarat University will carry a bit more weight, and maybe make the Justice system wake up to reality.
At the end of the day any ruling could come down to status alone - whether whoever from the University is named on the petition is seen by the judge as higher up in the pecking order than the parents. And of course the Uni will know that.
How much is a 'whopping' fine? That of course is for the court to decide, but it clearly needs to be enough to send the right message. So lets say 50 million baht per life lost - which wouldn't be too extreme by Western standards. OK - the parents can afford it - the main point is to make people think twice.
Will it happen? Please refer back to the flying pigs! :banghead:

Decision delayed on charges for teen in fatal crash

The public prosecutor will postpone a decision on legal action against a 16-year-old girl over her involvement in an expressway accident that killed nine people in December.
The accused had appealed for justice and urged the prosecutor to investigate whether the driver of the minivan involved in the crash drove recklessly, hence contributing to the fatal accident.
Supak Sitthiwanich, special attorney for juvenile cases, said Wednesday that the decision on whether to prosecute the girl for reckless driving causing deaths and serious injuries, slated for today, would be postponed.
The accused on Monday appealed for the probe on the driver. The prosecutor will ask police investigators for their opinion before deciding whether to take the case forward.

Comment - By delaying it, they are just prolonging the much needed message to be sent out that justice and the law is for all, and that the privilaged do not escape it. Doing this would be a positive thing for the whole system, not just the governmant. I wonder if there has been any "exterior" infuence/considerations regarding this decision. People will think like that and is exactly what they should be trying to avoid imo. :roll:

Why should there be a case to decide if the girl should be prosecuted in the first place? If she wants to question the part of the van driver, then she should do so as part of her defence in a court of law, just as you or I would have to do, juvenile or not.

It is cases like this that make it easy to understand why some people in this country prefer to sort it out with a hired gun. :guns:

An 18-year-old girl who was the driver of a sedan which collided with a passenger van on the Don Muang tollway in December 2010, causing the death of nine people, was given a suspended two-year prison sentence by the Central Juvenile and Family Court on Friday.

On the night of Dec 27, 2010, a Honda Civic driven by Orachorn "Praewa" Thephasadin Na Ayudhya, who was 16 at the time, collided with the passenger van on the elevated Don Muang tollway.

The van then crashed into a barrier near the Bang Khen exit. Passengers were thrown from the vehicle and fell several metres to the road below. Orachorn sustained minor injuries.

Victims' families have filed lawsuits seeking tens of millions of baht in compensation.

She was charged with unlicensed and reckless driving, causing death.

The court initially imposed a three-year jail sentence but reduced the term to two years because she had been helpful, reports said.

Orachorn's prison sentence was suspended for three years and she was put on probation.

The court also banned her from driving until she is 25 years old.

Before the court made the ruling, Pol Col Saran Nilawan, the father of Thammasat University first-year student Chutiporn Nilawan who died in the crash, said the defendant had never apologised for what happened, possibly because she might be afraid that it would affect the case.

"I hope the court's ruling will favour the prosecution and I don't think a 120 million baht compensation order would be too much when compared to the incalculable losses," the father said.

There was no immediate comment from him after the sentencing.

Comment - What a joke! This sentence should rightly cause anger as it's simply another case of some brat kid of a rich and powerful daddy (shades of the sentence given to the Mercedes psycho killer at the bus stop) exercising their influence to get the arrogant and errant waste-of-space off the hook. I hope the victims damages claims are approved and some recompence might come about.

when a police colonel gets rolled over then you know that its a real hi-so involved. Police colonels arent normally people you would argue against....

The Appeals Court on Tuesday upheld a two-year suspended jail term handed down by the Juvenile and Family Court on a woman, who was then 16 years old, who drove a sedan that crashed into a passenger van on the Don Muang elevated tollway, killing nine people, in 2010.

The court of first instance sentenced Orachorn "Praewa" Thephasadin na Ayudhya to two years in prison, suspended for three years. Her name was supressed because she was then only 17, despite being an unlicensed and underage driver.

Praewa's family is very well-known in Thai high society. She is now 21 years old.

27 Million is a big number, but break that down into Pounds Sterling, it works out to less than £40,000 per victim.

Court cuts damages for tollway crash victims

The Appeal Court has cut the compensation demanded by 28 family members of the victims of a 2010 Don Muang tollway crash to 20 million baht from 30 million ruled by the Civil Court.

The case involves the incident in which Orachorn "Praewa" Thephasadin na Ayudhya drove a borrowed Honda Civic and hit a passenger van while she was trying to overtake it on Don Muang tollway on Dec 27, 2010.

The impact caused the van, which carried 14 people, to overturn and hit the barriers, unlatching the door. Eight people were sent hurtling down the streets below and killed. Another one died later at a hospital while the others were wounded.

Orachorn was 16 years old at the time. The minimum driving age in Thailand is 18.

Twenty-eight family members of the victims filed a civil suit against Orachorn, her parents, the owner of the Civic car and an insurance company demanding damages totalling 113 million baht and 7.5% interest a year.

The Civil Court ruled on Nov 26, 2015 that the defendants pay 30 million baht to the plaintiffs in amounts ranging from 4,000 to 1.8 million baht each, plus 7.5% interest. The plaintiffs and some of the defendants appealed.

The Appeal Court decided on Wednesday the incident was not caused by the Civic driver alone -- the driver of the van also drove at a high speed. It ruled while the van driver was reckless, he was not as reckless as the Civic driver as claimed by the defendants.

The Appeal Court decided the rates set for the defendants by the first court were appropriate. But since the van driver was also at fault, it ruled that the defendants pay four-fifths of those rates, or 80,000 to 1.44 million baht each, totalling 19.8 million.

For criminal action, Orachorn was charged with driving without a licence and reckless driving causing death and injury.
She was eventually sentenced to two years in prison, suspended for four years. As a condition of her release, she was ordered to perform 48 hours of community service each year for three years, or 144 hours.

Victims of horror crash still seeking compensation

A "high society" woman who killed nine people and injured four others in a 2010 tollway crash has become the subject of renewed criticism after details of a subsequent nine-year court ordeal emerged.

An interview with several relatives of the dead crash victims that aired on a news talk programme on Thairath TV on Monday has sparked public outrage.

In a clip that has gone viral, the relatives told the programme they had not received a single baht in compensation over the past nine years.

On Dec 27 of 2010, Orachorn “Praewa” Thephasadin na Ayudhya rammed her car into the rear of a passenger van carrying students and staff from Thammasart University’s Rangsit campus on the Don Muang Tollway.

Orachorn was 16 at the time, and not eligible to hold a licence. She was initially charged with reckless driving causing death.

In 2011, she was also charged with driving without a licence, reckless driving causing death and injuries, property damage, and using a mobile phone while driving.

She was sentenced to three years in prison, which was later suspended.

She was ordered to perform 48 hours of community service annually for four years as a condition of her release. According to an official court document, Orachorn used a different name, Rawinbhirom Arunvongse.

The affected parties then sued Orachorn. On May 8, the Supreme Court ordered her to pay 26 million baht to the surviving victims and the families of the dead victims in amounts ranging from 4,000 baht to 1.8 million baht. The case involved 28 plaintiffs.

Following the Thairath TV programme, one injured victim using the Twitter handle "@tintinwaranyoo" posted that he has yet to receive the 4,000 baht due in financial compensation.

He also posted the official court orders. He revealed that he was a third-year student at Thammasat University travelling in the passenger van at the time of the accident.

He claimed that the lawyer representing Ms Praewa challenged him to pursue the 4,000 baht compensation in a bankruptcy case and offered him a financial settlement of less than 4,000 baht. He did not accept the settlement.

"The lawyer bargained with me to reduce the money as much as possible. It is as if he was bargaining for vegetables and fish in a fresh market," he wrote on his post.

Thawatchai Thaikheo, deputy permanent-secretary of the ministry of justice, said the ministry is ready to offer legal counselling to plaintiffs in the case.

The mother of Orachorn "Praewa" Thephasadin na Ayudhya has promised to sell the family's land to raise money to pay the 24.76 million baht in compensation ordered for the families of the dead and injured victims of her young daughter's horrific car crash in 2010.

Ladawan Thephasadin na Ayudhya told a TV interviewer on Thursday that her family would sell 21-rai of land worth about 50 million baht in Pran Buri district of Prachuap Khiri Khan. If that was not enough, they would sell another 300-square-wa worth about 55 million baht in Muang Thong Thani housing estate in Nonthaburi province.

She said the family did not pay right away because it did not have enough cash. She suggested the Justice Ministry use its justice fund for quick compensation payment, and her family would later reimburse it.

Mrs Ladawan was adamant family intended to pay the compensation. She apologised to the victims and their families, saying her her family shared the suffering of the victims. Her daughter suffered from depression, and the whole family depended on sleeping pills.

Commenting on the case, Deputy Prime Minister Wissanu Krea-ngam said on Thursday that if people convicted by the courts tried to avoid paying ordered compensation their assets could be confiscated and auctioned off to raise the money.

On the late night of Dec 27 of 2010, Orachorn drove her car into the rear of a passenger van on the Don Muang Tollway near Kasetsart University in Bang Khen district. Nine people were killed, many falling to the ground below the elevated tollway, and the others in the van were injured.

Orachorn was only slightly injured. She was 16 at the time, and not eligible to hold a licence. She was seen in photos posted on social media standing beside her car and chatting on the phone after the crash.

In April 2014, the Appeal Court sentenced her to two years in jail, suspended the sentence for four years, put her on probation for three years, and ordered her to do 144 hours of community service over the three years. She was prohibited from driving until the age of 25, her age this year. The Supreme Court dismissed her appeal.

The relevant civil case was finalised on May 8 when the Supreme Court ordered her and her parents to pay 24.76 million baht compensation to the affected families. There were 28 plaintiffs in the civil case.

There isn't a word in the dictionary meaningful enough to describe this disgusting situation.......
