The Supreme Court ruled on Thursday to ban Palang Pracharath MP Pareena Kraikupt from politics for life over her use of land in a forest reserve in her home province of Ratchaburi.
The court's Criminal Division for Holders of Political Positions said she had severely violated political ethics as an MP by her possession of state land, which posed a conflict between personal and the public interest.
The ruling means she cannot run for political office at any level, national or local. She is also banned from voting in any election for 10 years, the court said.
The ruling was applied from March 25 last year, when she was temporarily suspended by the court from all House activities pending a final ruling, which was delivered on Thursday.
Her suspension was proposed to the court by the National Anti-Corruption Commission (NCAA).
Problems surrounding Ms Pareena’s use of land in Ratchaburi came to light in November 2019, when Ruangkrai Leekitwattana, a then-member of the since dissolved Thai Raksa Chart Party, petitioned authorities to inspect the MP’s 711-rai poultry farm in Chom Bung district.
The Royal Forest Department then investigated and surveyed the land. It concluded that her farm encroached on public land. It then asked the NACC to take action against her.
The land under her control was reform land, which is allocated to landless people but remains reserved forest land.
Ms Pareena did not attend the court on Thursday and was represented by her lawyer Thiwa Karnkrasang.
The ruling means a by-election must be held for her House seat in constituency 3 in Ratchaburi within 45 days
The former MP could also face criminal charges in the same case. The Natural Resources and Environmental Crime Suppression Division forwarded the case to public prosecutors in Ratchaburi in November 2020. A decision on indictment is pending.

The Ratchaburi politician posted a Facebook message saying she would soon make a comeback to politics, although not in parliament.
"See me soon. This time outside parliament," she said.
Ms Pareena, who has been a strong defender of Prime Minister Prayut Chan-o-cha, can no longer stand for political office after a Supreme Court ruling on Thursday banned her from politics for life.
The court punished her for "severely unethical conduct" in her use of state land for a chicken farm in a forest reserve in Chom Bung district of Ratchaburi, her political base.
She had not lost a political fight in Ratchaburi for almost two decades before the court dealt her a blow on Thursday.
"Pareena was sentenced to the political death penalty, as if I had committed the most serious offence," she wrote, but said she accepted it.
A by-election for her now-vacant electoral seat on constituency 3 must be held within 45 days. The Election Commission has not yet met to set the date.
The criminal case against Ms Pareena over her use of the state land remains with public prosecutors, who have yet to make a decision on indicting her.

Ms Pareena’s Facebook post was false and caused damage to the plaintiff, Ms Pannika declared in her suit.
The Criminal Court sentenced Ms Pareena to one year in jail and a fine of 100,000 baht. The court commuted the sentence by one-third to eight months in jail and a fine of 66,666 baht because the defendant gave a useful statement. As she had never been jailed before, the court suspended her prison term for two years. She appealed.
Ms Pareena arrived at the court on Tuesday to hear the ruling.
The Appeal Court upheld the lower’s court judgement.

What does a "suspended for 2 years" mean here? In 2 years she goes into the clink, or if she behaves for 2 years with no other offenses it's cancelled?

In most jurisdictions it means that if you don’t misbehave during the two years then the sentence is deemed served. But as TIT, it could be different?
