Okay thanks guys. I may just go that route myself next time as it's cheaper than trekking all the way to Kuala Lumpur and that just for a 90 day stamp. Being able to extend for a year no longer applies to me as I simply do not have 400K in the bank
Does anyone know if there is a way around this problem of 400K. I tend to recall that it's possible for a Thai to act as your guarantor (spelling?) but I'm not 100% sure.
If anyone has any helpful information which they are not wanting to post on here, please PM me
Cheers

I have heard that there are two options. Either you must show that you have a fixed incomme of at least 40K a month or 400K in the bank. If you go for 400K in the bank, your account can not at any time show less than the 400K you deposited. This is the rules if you are married to a Thai. If you are over 50 years old the amount is 800K in the bank or 60K a month. PS. do not take this as granted, because this are just rumors given from friends of mine.
For an annual marriage extension to a Non O visa, you must show an average monthly income of not less than 40K. This is evidenced by a confirmatory letter from your Embassy. Embassies differ in terms of what they want to see. The UK want your last three months bank statements, The US Embassy apparently just require you to swear on an affadavit that the income you state is correct. It's best if you ask your respective Embassy directly.
The 40K income must now come solely from the foreign husband.
Alternatively, you can get the extension by showing a minimum of 400K in a Thai bank account. That amount must be in the bank and not have dropped below the figure for two months before you apply in the case of the first extension. In subsequent years, the 400K must be in the bank for 3 months before application. Once you have the extension, you can draw on the money to live and top up back to the 400K in time for other extensions.
lazerlab,
For retirement extensions the figures are 800K in a Thai bank account or average income of 65K a month.
Takiap,
I'm not sure what you mean by a Thai guarantor and I'm not aware of any way that could work.
Perhaps you are mixing it up with the fact that until last year your Thai wife could contribute either partly or in full towards the 40K income? That is no longer possible and the income must come solely from the foreign husband.
A while back when the wife and I were at the immigration in Hua Hin she heard one of the women officers mention something regarding acting as a guarantor. It appears that she is/was married to a farang as well?
About the 40K monthly income.................in order to satisfy immigration that I do have a minimum of 40K per month, do I only require a letter from the embassy or do you also need to provide bank statements, etc to immigration? Also, are you required to declare your income for tax purposes?
Thanks in advance

From Inland Revenue, link http://www.rd.go.th/publish/6045.0.html 1. Taxable Person
Taxpayers are classified into "resident" and "non-resident". "Resident" means any person residing in Thailand for a period or periods aggregating more than 180 days in any tax (calendar) year. A resident of Thailand is liable to pay tax on income from sources in Thailand as well as on the portion of income from foreign sources that is brought into Thailand. A non-resident is, however, subject to tax only on income from sources in Thailand.
There's a section in the link about tax treaties with countries, if you're paying tax on it elsewhere, surely you don't have to pay it here again too!?

Up until a month or so ago, a Thai wife could declare an income of 40K a month, pay the tax on it and the foreign husband could apply for the "family" extension on that basis. Imm calculated the wife's income based on the tax receipt.
Note that it was a family extension, not a "support Thai wife" extension.
Everything's changed now and the income must come from the foreign husband now. Don't ask me about the rights and wrongs of that, it's just the way it is unfortunately.
Normally, the Embassy letter confirming your income should suffice. But as I said before, it's up to your Embassy as to what they require to issue you with that..
I took bank statements from the UK to Imm as well. They weren't asked for and I didn't offer them.
The Embassy letter should suffice, but......have back up.
I don't know anything about tax.
