On a side but important note.

Whilst waiting for the paperwork I would recommend buyer and seller go to either Tons bar or the beach hut in Takiap until they get the phone call that all is ready as the restaurant at the land office no longer sells beer.

Hi Pls can anyone tell us answer to these question?

My wife want to transfer house + the land to brother In HH. No moniey will change hands she is giving it to him. What are taxes that have to be paid by her or brother. Land about 68 wah. Wanting it done properely with chanot correct.
I have looked on here and all about sale house not free transfer to family members so I canot find any info.

Anyone have Hua hin land ofice phone number one we have does not be working.

A lot of the info you want is on this thread, and in other threads, but it is confusing as hell. But you can't rely too much on what some of us know (or think we know), as even if it's generally right, it all depends on the day what official you deal with, how they interpret the rules, what they might want to 'negotiate' with you etc.

Bottom line is there's no such thing as a free lunch as they say, so you can give your property away but the government will still want certain taxes from your wife unfortunately. As it says above: "the transfer tax is applicable to the 'assessed value' of the land, not the 'actual sale value'. The Land Office's assessed values are usually much lower than the actual values"
So, the government departments, land office/Tessabahn/inland revenue, that collect taxes can use their own assessed valuations where they are higher than the actual sale price. As your wife's will be 0 Baht, there's a strong possibility the assessed value will be higher :D

The main one your wife wants to take good advice on is potential personal income tax from the sale of the property, as this can be high, but depending on her circumstances she may be exempt. You might want to consider getting some level of advice before contacting the land office, so you know what angle to approach it at.

A lawyer/accountant might suggest a document certifying that it is a 'gift', as has different tax status. And this genuinely is a gift by the sounds of it. Also they may suggest just registering the transfer of land only, depending on how your wife's current set-up is regarding the house ownership is. Ie: many Thais would not have the house registered as a separate entity to the land.

Yes it very confusing for a learner as i have tried to find out what tax she is being have to pay
She want transfer house and land all to brother and have transfers writen on chanote.
She paid about 800,000 baht for land in about 2002 and about 1.5 million for have house build.

Does she having to pay taxed on transfering land and taxes on transfering house as well.

im trying to get % of tax rates but difficult to get a set % on one and other.

I dont think she can afford lawer can she just write letter to say it is gift will office acept that?

I read here that she may haveing to wait 1 month from first visit to land office and go back 30 day later before transfer can be complete is that corect? or is that only when money/ sale is invollved.?

any one have phone number of office for her try call them to speak about this
