Seriously overloaded in my opinion these type of pleasure craft aren't designed for heavy payload with such a shallow draft they become top heavy. I would like to know the boats manufactured specifications on how many person's it can carry i bet it's less than half the amount that was on board. I've always had an issue with marine safety in Thailand and only once got this old chugger of a chinese ferry across to Samui.

Tragic but This Is Thailand.
In seas big enough to 'crash over the bow', the sane thing to do is head straight into them until they subside. I have difficulty imagining a Thai tourist company doing that - or tourist companies in many other countries. It's easy to imagine the captain making a straight line run to the harbor while taking big waves at an angle. That's a recipe for a capsize.
It's always a good idea, IMHO, to check the marine forecast before boarding a boat one is not in control of. Commercial operations can be quite relaxed in risk assessment when revenue is at stake.
