Sickness - Thai wife/UK husband

Not sure where to post this ...

I am a UK national - still working.
My wife is a Thai national - here in the UK on a spouse visa. Been here 17 months. We need to do the second application (for another 2.5 years) of course for her to be able to apply for a settlement visa.

I have just discovered that I am very ill - and may not have a year to go.

If I should pass away before the next 2.5-year visa is applied for, what will happen to the wife? Will she need to go back to Thailand?

Can't help with your question but, though I don't know you, would like to offer my prayers to you at what must be an incredibly difficult time. Stay positive fella.
I don't trust children. They're here to replace us.

Very sorry to hear about your illness - try to stay strong.

I have seen this happen a couple of times when I was living in the UK. The answer to you question is yes, she will have to return to Thailand. In the event you pass away, she has no legitimate reason for remaining in the UK. Very harsh, I know, but that is the way it is.

Beware jealous relatives. In my experience they will see your lady as a gold digger, and try to screw her out of any inheritance. Make sure your wishes are clearly known and recorded in your will should the unthinkable happen.

In the middle of life plans comes bad news. Once the medical prognosis is firmer and immigration questions answered it may be time to have a sit down and think through together where best to spend the rest of the time you have left. My wife is adamant that she could cope with a seriously ill spouse much better where she had support and caring help rather than here where we have excellent medical care but without much of a support network. We are putting my Thai immigration status and our finances here in order so we can focus on each other when time is suddenly short,

Again, many thanks - I know immigration can lack compassion, so, no real surprise there.

Thankfully my 2 sisters are not interested in my money, both are well settled. My will has been written and is at the lawyers, but thanks again for the reminder.

My wife seems to think that she will be allowed to stay. Not sure why she would think this (pie in the sky)

blahblah, I need to mention, my experience is over 6 years old now. Please check with the Home Office - things may have changed. They will, at the very least tell you how it is, and at best might help you to achieve what you want.

They are Civil Servants, not ogres. At least they're not ogres until they give you the answer you don't. It will help you to plan things.

Just as large, or bigger, concern might be family and extended family here. Who might see her as having a windfall pot of gold that shud be shared - until it is completely gone. The pressure can be huge. If possinle a Thai will wud be beneficial too if there are any assets here. Or at least an official Thai language translation of the UK one

Until checking, I hadn't realised how much the foreign spouse visa had changed. My wife should consider herself very lucky. Back in the day, my wife got a 1 year visa then extended to 'indefinite' by post. It was only when we had decided to move back to Thailand that she applied for citizenship (by post). In fact we had already moved here when she was granted citizenship. She did her 'swearing in' at the British Embassy and applied for her first British passport from here. (again by post).
My, how things have changed! I feel every sympathy for people going through the 'treadmill' now.

There are no assets in Thailand - when we come over we rent.
She has no contact with her Thai family at all - last spoke to them 12 years ago.
They are very well off indeed (much better of than me) - and they would have no interest in my mortgaged house and the small savings I have.

Big Boy, Immigration is crazy now. They look for pretty much any small reason to reject an application. Our last experiences with them cost us many thousands of pounds in lawyers, application fees, missed flights etc. I would not trust them at all. I would need to ask anon, or ask an up-to-date immigration lawyer.
