Fact or fiction?
Fact or fiction?
Hi all
I have just been told by my Danish neighbours that immigration will be moving to Market Village as from the beginning of next year. They said they went around to see the new premises and just as the immigration officer had said, the new premises are not 100% completed yet. Also, apparently they will have a room set aside with an English person on hand to assist with communication problems. Lastly, they were told that a new police order will soon be released as the government attempt to make being here easier?
Like I say, I have only been told this so I can't say if there is any truth in it but the neighbours who told me are pentioners and have no reason to spread rumours.
A little off this topic I know but I'm asking anyway...............I intend going to KL arounf the 27th of this month for a one year visa (thai wife). Can anyone tell me if the requirements are still the same or have they changed as well?
Thanks in advance

Sorry ... couldn't resist ...
In the light of recent visa clampdowns this is very unlikely ... unless of course the Democrats get in and undo all the restrictions on foreigners Toxin put in place. We live in hope ...

Takiap,
I've heard conflicting reports about getting a multi-entry Non O from KL. My feeling is that you've got as good a chance of getting it there than any other Thai Embassy/consulate in the region. (I assume you're talking about the multi-entry).
If you go with your marriage certificate, copy of wife's ID card and tabien bahn, you'll certainly get a single entry Non O, good for 90 days.
If you get her to write a letter confirming that you're living together and that you're supporting her, that won't amiss. Also, take some financial evidence, whether it be bank statements from your home country or here showing income or a lump sum. Basically you're giving proof of your ability to support your wife. There are no hard and fast rules about the financial requirements when applying for a visa (unlike if you're applying for an annual extension here in Thailand). It's really up to The Embassy and how they feel that day.
Good luck and please report back as up-to-date information is valuable for the forum.

Hi Lomu
Yes sure I'll report back on here with an update. Last year I had no trouble with getting one. Just had to show copy of wife's ID and copy of marriage certificate and I also offered copies of of birth certificates of our two kids but they wer'nt interested in those. Got the visa two days later instead of the following day because the Thai prime minister was visiting so the embassy was closed.
Anyway, I'll keep you all informed.
I would apply for the extension but I don't have 400K in a bank and if we show 40K monthly income it would need to be mine and the wife's combined. My share is from freelance writing so not sure if they would accuse me of working without a permit although I write for a US company in the States and simply transfer money into my wife's bank account via PayPal. Having said this, perhaps someone could offer advice as to wether or not this is considered working in Thailand?
Thanks in advance

If Imm wanted to, unfortunately I reckon they could decide that you are working here even if you're doing it remotely through The USA.
The law regarding marriage extensions changed yet again a couple of weeks ago. It appears that it's no longer "family income" of 40k a month whereby your Thai wife could contribute to that amount. The 40k has to come from the foreign husband alone.
Crazy, I know, but there were people bending the rules and getting their Thai wives to pay tax on fictitious income of 40k a month so they could qualify for an annual extension. That loophole appears to have been closed but as usual the all embracing new regulation hurts genuine people as well.

Hi Lomu
Yes I know what you mean regard immigration being able to say I'm working here but then really, that also applies to anyone playing the stock market or buying and selling shares abroad. In fact it would apply to anyone having any form of contact even with their employees back in their home countries.
The fact is that I am employed, if only on a freelance basis through a company in America and none of the work I produce relates to Thailand and nor is any of it published in Thailand.
I realise I took a chance but when I last did a visa run at Ranong, I asked the immigration officer the same question. He asked me who I work for and when I told him it was an American company, he asked me if they are in America or Thailand. When I said they were in the America he simply smiled and said, "no problem, not working in Thailand"
Now of course one has to remember TIT so the next officer may have a very different understanding of the law. It's a difficult answer to get really because if you ask a lawyer, they will try to sell you their services for work permits etc even if you're flying to the moon to work.
It just seem to me that if you're here in Thailand but you're playing the market overseas, you're still in essence earning an income from within Thailand which in turn could be considered as working here?
Anyway, as I don't get paid into a Thai bank, I suppose they will never really be able to tell for sure. Perhaps I'll get the wife to ask at immigration when next we're in Bangkok.
Thanks anyway and I'll keep you allposted.

Takiap. I asked the same question on another board a year or so again and was also informed that if you got caught there is a good chance that you could get deported as you are working here but getting paid in another country (paying no tax in Thailand).
I also freelance as a technical writer, one publication is done on an annual basis and one on publication by publication basis. All processed online into databases at my contractor offices. I had toyed with the idea of doing the same, but did not want to chance it.
I could probably get away with it by spending 90 days here and then going back for 3 months and then doing the same again. But the problem is, you have only got to let it slip accidentally what you are doing to the wrong person and you could be on the next plane out with a black mark on your passport. I am single, so no big loss to me, but you with a family, is it worth the risk.
Somewhere down the track you could be asked to provide proof of income (for whatever reason) and that is where you could get in trouble.
Is up to you whether you feel it is worth the risk.

Agree with Chelsea, not worth the risk of working in Thailand without WP as evading Thai tax comes into the equation too.
You need a WP here whether you get paid overseas or even if you do not get paid anything, ie: working for free.
The new regulation says the 40k has to come soley from the foreign husband. If you are actually doing the work outside Thailand, you can then demonstrate that and no problem.I would apply for the extension but I don't have 400K in a bank and if we show 40K monthly income it would need to be mine and the wife's combined

So I guess the following are in violation .
Your mate helps give you a jumpstart .Then you take your and your friends kids to school .
You climb up a ladder to trim your frangipani tree and then water your lawn .
You give someone advice on how to find the post office or where to go fishing after getting chatting in a bar .
You offer advice on a web forum regarding a number of subjects .
You cut your own toenails and clean your own teeth .
etc..etc..etc...
