How long to sort out my affairs after a death?

My friend and neighbour recently passed away and naturally his wife has a monumental job to sort out their affairs.

They are both farang.

Rogers body has been cremated and the British Embassy notified re cancellation of his passport etc.

The Tessabahn have been advised. Someone at the hospital said the police should also be advised.

They have the required money in a bank account (Rogers name) for a retirement visa.

90 day report is due in a few weeks and retirement extension due in September.

She would like to sell their home and then return to UK.

I believe there is a will leaving everything to her.

How long has she got to sort out bank accounts and visa extension in her name before she is asked to leave the Kingdom.

Anyone with experience of this situation, please give us some advice.

It will depend on what basis she is in the country. If she has permission to stay in her own right then that will continue. If she has permission to stay as her husband's dependant then I believe that she is already out of time (legally speaking). She should attend immigration immediately to see how to regularise her continued stay.

Yes she is the husbands dependant.

As you have posted that they are both Farang, then how is the house owned? Really should engage a lawyer immediately to get proper advice.
As far as I know if the deceased passed away in hospital it is the hospitals place to notify the police. If at home then a different matter.

Lawyer would be a good idea. Also, I notice that the husband has been cremated already so this indicates some time since his death. As far as the law is concerned the wife has been on overstay since his death. If nothing has been done about immigration status yet, it might be worth consulting a lawyer or immigration agent about this. I imagine the wife is in a similar situation as a foreign male on a marriage based stay would be if his Thai wife passed away.

For bank accounts in the husband's name she will probably have to wait for the will probate process to complete, assuming the bank accounts are included in the will. If a lawyer is handling probate he can possibly help with the other stuff (immigration, property, etc.) as well.

I have sent you a private message as I went through all this last year. She is not on overstay her visa is valid until the date it says.

If it's a visa then I agree with you. If it's an extension of stay then I hope you're right.

Mojave’s is correct.

We went to immigration yesterday. She was advised that the current extension is valid for her.

She must continue with 90 day reports and prepare to re apply for a extension in her name when the current one expires in September.
The lady explained that she must have the bank account changed into her name etc. Most helpful. In and out in less than 30 mins.

That's great. One less thing for the bereaved to stress about. And worth knowing.

It just shows that you can't believe everything you read on other forums and visa agent sites. It's best to go get the official ruling from immigration.
