Sort out visa problem while in ASQ

Post by Gregjam »

So I thought that getting in before my non-imm visa extension issued at Hua Hin immigration expires on 10th would give me 3 months to get things sorted. Just noticed that at immigration this morning they stamped me in until 10th Feb 2021 and will be stuck in ASQ well beyond that. Was too tired to spot it this morning and ask.

Has anyone got any experience of this and what the next step is, who to approach.

Suggest immigration call centre as first step. 1178.

I don't understand why you would think you have 3 months to get things sorted if your extension expires on the 10th. In my experience, the annual permission to stay does not carry any 'grace period'. The 'permission to stay until' is the latest day you can apply for a further extension. End of! Of course immigration, depending on the officer you deal with, has the power to act on mitigating circumstances. I'd say you require a further non-o visa which is difficult to apply for whilst in ASQ.

There's only 6 days to solve the problem, and 2 of those are a weekend. I think you need to get on with an agent asap who can do the running and talking for you. You can basically do nothing yourself while in quarantine.

Having gone through the whole COE thing declaring flights etc and subsequently getting the COE I mistakenly assumed the ASQ would be taken into account. As usual thinking logically has resulted in this. At least I am here after leaving Australia rather than flying back to the UK and sorting out a new visa plus trying to get flights again. I am guessing I will have to take an overstay hit but certainly will give the local immigration a heads up to show good intent.
On the subject of visa agents, can anyone recommend one in Hua Hin? This is one occaision when they will be of assistance.

Yes. You could also try the main government help line on 1111.

All I can do is point to the one who advertises on here, and has mostly good comments and recommendations. I personally have never used them.

^ Tum can get anything sorted out for you. She is more of the boss around there than the boss is.

Where are you at the moment - Bangkok?

Edit - meant to add, wasn't your Thai visa status queried by the Embassy at all? They must have known it was about to expire, or did you come in with a 45 day visa exempt?

Caller, you have hit the nail on the head. I cannot understand why I was allowed in if this would happen. This was never mentioned to me. Everything was done correctly via the COE website and all documents were genuine. As this is Thailand I am sure with the help of my Thai family, and it sounds like a good idea to get them to chat to Tum, I am confident things can be resolved. I will just have to sit our my ASQ days here in Bangkok and allow the family to deal with things initially in Hua Hin. The most likely outcome will be that I have to be there and pay the fines graciously.

Maybe the hospital can sort it out for you?

Pre-covid, there were lots examples of those who were hospalised but didn't lose their extensions or have to pay fines because the hospital took care of it for them -at a price I'm sure.

I got the wife to visit the local immigration office and as has already been said it looks like a 500 baht per day overstay fine but they are showing understanding. Another option would be to or try to get the visa renewed from ASQ using an agent. As the visa process will require the usual numerous copies and bank statements etc then I will endure my remaining time in ASQ, take the hit and be able to be there to provide the details and support required.
My intention is post here once everything is sorted to at least give this thread a conclusion rather than leave it hanging, if it proves helpful to one person then it will be worth it.
