Recommend a Lawyer???
Recommend a Lawyer???
I am having trouble getting my security deposit back from an expired condo rental. (And the worthless agent will do nothing.) Anyone know a Thai lawyer who can intercede without costing me all of the deposit?
Or, any other advice??

Thanks....

Might be able to help with some advice...
For the sake of clarity, what do you mean by 'expired condo rental'?
Has the rental agreement/contract expired?
Have you moved out of the condo already?
Are/were you up to date with the rent?

If you or your wife know a police officer, they will do a much faster job than the lawyer, and a lot cheaper. Sometimes just the threat of the police getting involved is enough to make them pay.

Chavilit will cost you more than you have tied up I am sure, as someone else stated get a cop to go around and have a word that will sort it out quickly.

Unless he/she decides to pay the cop more than you are willing to pay him for his services...Chavilit will cost you more than you have tied up I am sure, as someone else stated get a cop to go around and have a word that will sort it out quickly.

Re: Recommend a Lawyer???
As stated above. getting a lawyer involved will cost you more than the deposit and you are not guaranteed to win any way. Put it down to lesson learned and move on.
I never forget a face but in your case I'll make an exception!

No more info OP?
I was hoping for some more insight into your situation as I have had a similar situation myself and learnt from it- so (if you haven't broken the terms of the contract or done anything else silly, which i am sure you haven't) why is the landlord refusing to return your deposit?

Because he can is about what it boils down to. Going to court is time consuming and expensive and for me wouldn't be worth the stress for the sake of a couple of hundred quid.PBbeacher wrote:No more info OP?

When I first came here I rented and always used the deposit as the last months rent. never had any issues.

Hi Dunc,
It doesn't happen often, we haven't had any deposit withheld without a good reason.
Also never happened to me in 8 years of renting.
When you visiting HH again, be good to get a beer!

Re: Recommend a Lawyer???
Many Thai landlords have no intention of returning the deposit and view it as key money. Beware esp those that ask for more than 1 month deposit. They are also aware that many falangs will just give up on trying to get the deposit back, or may be returning to their home country.
When possible, use the deposit to pay the last months rent. Many savy Thais know the reason for doing this is so the renter is not out the deposit.
I have successfully retrieved 2 of my deposits using police. The last deposit we were being stalled. My wife finally called them up and said her uncle was colonel so and so, and that he was coming over to see the owner. We had the deposit back in less than an hour.

I'm hoping to get away for a long weekend soon JW. HH would make a nice off island jaunt. It would be good to see just how much the place has changed since I left. Is Bob still up at Easyriders on the back road ?JW wrote:Hi Dunc,

Re: Recommend a Lawyer???
To all who replied: "THANK YOU"
FYI: My contract expires 01/10 and agent has told me 30-days+ to get refund. My condo has no damage at all and my rent has been paid on-time every month. The deposit is not chump change, it is - 86,000. (The contract states deposit to be paid upon expiry.)
Maybe, from what the advice has been, just getting a cop is enough. I will threaten with that action and go to police if deposit not paid when I leave.
