FURTHER CLARIFICATION
1/The Land Office document comprises 2 pages stapled to the front of Ton's contract, and complements the original contract. Ton's clerk signed it on behalf of both parties by power of attourny .
2/The clerk's instructions were to register the lease, NOT make material alterations.
SHOULD I SUE FOR MALFEASANCE? Would it be worthwhile?
3/When I realized I had been cheated in the Court, I went to Ton for assistance. Alas, he dithered and messed about, wasting valuable time, and so we were unable to appeal. Ton is a Notary, not a fully fledged lawyer, and is of limited capability in complex legal matters.

Are you saying you have a copy of your 'Limited Power' POA with the instructions on it just to register the lease and not add pages/clauses to it?

Was Ton the 'lawyer' you describe as representing you in court and regarding an appeal and doing a bad job/working against you, or are they different one's?

Just to clarify things a bit as I'm no expert on Thai property law; if the lease ammendment was signed by the clerk on behalf of both parties, why exactly did it invalidate the lease?

I found the bit about CP putting Joe largely out of business interesting.

A lovely example of unbridled free market capitalism in action eh?

Its a sad story, and Farmer Joe looks like a decent sort of bloke which makes the tale all the sadder. Cant trust your wife, cant trust your so called lawyer.... f me who can you trust?

Poor old bugger

Hope things get better for him and the court cases work out

Surely the word's 'corruption' not 'capitalism'!? But anyway it's not a free market, the business is in the top group of activities prohibited for foreigners to operate, as is property like many of us do so not passing judgements at all. You make a decision to take on the risks that come with it and personally I see nothing wrong in a legit company putting me out of business to be honest. I personally wouldn't resort to that tactic though.

Good Luck Joe.

It happens to often - and not just in Thailand.

4/My lease was drawn up by Khun Ton (P&A Notary Office). The agreement I signed in his office was complete, and perfectly legal. When his clerk went to the Land Office the next day to register the lease, the toxic clause "residency & orchard gardening" was added in a Land Office document....in my absence, and without my knowledge or consent. My wife was in contact with the clerk at the time by phone!
Do you have some more news about K.T. (Pi and Ai N. Office)?
I had big trouble with them also!

Andrew Drummond writes some good articles, but he is vengeful towards anyone that criticizes him or gets into an argument with him.
