Dead father's Annuity Payments to be returned?

Has anyone had a similar situation to this, sorry if this is a bit long.

Anyway..My father died in Jan 2010 in Spain where he was retired. I informed his annuity company of this by phone and sent them the death cert as requested from them. After they received this I was sent a letter confirming the contract had been cancelled and that no further payments were due. But they noted to me that the Feb 2010 payment had already been sent to his Spanish account, and could I return a cheque for this amount, which I did.

In Jan 2013 I received a letter from them asking for the return of payments, amounting to £1300, that they had mistakenly sent to his account between Feb 2010 and Nov 2012.

I emailed them as a reply to this letter stating that I was unaware that further payments were being made as it was his closed account, and sent them a copy of the letter showing that they acknowledged his passing, and receipt of death cert and closed the contract.

The inheritance was split between myself and 4 other family and non-family members and was a very stressful time for me and my wife especially. It took 3 years to complete as my fathers house was involved.

I have not replied as yet to the recent email I have received this week from the financial company, but I have contacted the Financial Conduct Authority for their advice. What do you guys think??? :?

I'd contact the bank next. If the account was closed, how could the annuity company be paying in money?

Yes, I would have thought that once the account is closed, any further dispute would be between the bank and the annuity provider and nothing to do with you.

Thanks for your inputs guys. Yes that had crossed my mind. But as I am in Oman and the bank is in Spain its not that easy. Also the bank in question are the most helpful I have used in Spain. But will give it a try.. :cheers:
