The Appeals Court has reduced the prison sentence handed down to the son of a former Miss Thailand, who rammed his car into a crowded bus stop six years ago, killing one woman and injuring several other people.

Kanpitak Pachimsawat, 24, better known by his nickname "Mu Ham", was charged with premeditated murder, attempted murder and physical assault in connection with the July 4, 2007 incident.

The defendant is the son of former Miss Thailand Sawinee Pakaranang and businessman Kan-anek Pachimsawat.

He droved his Mercedes Benz sedan into a crowd waiting at a bus stop in Bangkok's Watthana district on July 4, 2007, killing one woman and grieviously injuring two other people, following a quarrel with the driver of a bus.

The bus driver accused him of deliberately side-swiping his vehicle with his Mercedes-Benz car in heavy traffic. The case caused much public outrage.

In 2009, the Phra Khanong provincial court sentenced Kanpitak to 10 years and a month in jail, rejecting the claim made by his family that he could not control himself as he suffered from mental problems.

The court blamed Kanpitak's upbringing and said the parents had contributed to his bad conduct.

The Appeals Court ruling was read out in the Phra Khanong provincial court on Tuesday.

The judges ruled the defendant’s appeal to be “partially convincing”. The court said that during the act of committing murder, the defendant was being irresponsible and was unable to control himself because he had a mental illness.

The court decided to reduce Kanpitak's jail term. It initially reduced the prison sentence to three years, and then further reduced it by a third to two years on the grounds that the defendant had paid compensation that satisfied the injured parties and family of the deceased, and that the plaintiffs did not want to file civil and criminal cases against him.

The judges said the conclusion about the defendant's mental state while committing the crime had been drawn after they discussed the issue with Kanpitak’s physician and other medical experts including psychologists, social workers, clinical psychologists and nurses.

The meeting concluded the defendant was mentally ill and had suffered from seizures since he was a child. He suffered a bipolar disorder which affected his ability to control himself when he was angry. Therefore the defendant’s actions were involuntarily.

As a result, the penalty on the premeditated murder conviction should be reduced, the court said.

On the assault charge, Kanpitak was sentenced to one month in prison, suspended for two years. The court ordered him to report to probation officers and undergo psychiatric treatment for his mental impairment.

After the accident, Kanpitak was released on bail after his family placed a six milion baht land title deed as security.

His bail was continued on Tuesday. It was not reported whether or not his lawyer indicated they would further appeal the sentence to the Supreme Court.

On what grounds? Convicted sentenced and unsure if another appeal is to be made.Prison now out of the question or wait another 6 years :banghead:

Who should be blamed for a legal system that allows convicted murderers to remain free within society without punishment - Thailand's parents? :wink:

Too mentally ill to go to jail but not sufficiently ill that he can drive a car. Totally Shameful!
Wait and see, it will be the same for Vorayuth Yoovidhya, of black Ferrari of Red Bull fame, if the case ever comes to court.

It's always the same for Bkk Hi-So's when it comes to any aspect of driving,- They drive at whatever speed they want, park where-ever they feel like it..no chance of getting a ticket tho'.
Yesterday morning near the 'Chicken Restaurant', on the Railway Rd.. (where hi-so's & whealthy Chinese frequent) an SUV was parked illegally..opposite all the other parked cars..this selfish, arrogant t**t was causing a jam the full length of the 'Railway Rd'!..Police came, saw the SUV had Bangkok plates, & the officer simply blew the motorcycle horn till a man came out & moved his car..then the officer went on his way, no ticket, no repremand, nothing. T.I.T.

Metropolitan Police Area 5 investigators submitted their final report on the hit-and-run case against Vorayuth Yoovidhya, grandson of the Red Bull energy drink founder, to the Southern Bangkok Court's public prosecutor on Monday.

The 27-year-old Vorayuth crashed his Ferrari into on-duty Pol Senior Sgt-Major Wichien Klanprasert and then fled the scene on September 3, 2012.

City police deputy chief Anuchai Lekbumrung insisted that the police had not dragged their feet but were carefully investigating the case within its time frame of six months. He said police did not fear criticism if the end result turns out like that of Kanpitak "Moo Ham" Patchimsawat, who got given a two-year suspended jail term yesterday for crashing into a group of people waiting at a bus stop and killing one of them.

I am certainly not surprised, I have lived here too long for anything much to surpise me. Upset, is a totally different matter and I still consider these instances of the "untouchable" as totally unacceptable, unjust and immoral. I can not believe that there will be a day when they do not upset and anger me.

I agree, but many farangs (not all of course) are guilty of encouraging low-scale corruption - how many times have we heard of them paying the BIB tea money for not wearing a helmet, drink driving etc? It's endemic from the top to the bottom, so it will take an almighty effort to change and I don't see a queue forming to do so.

This all started back in 2007 when we started the original thread! Finally it is finished and he is jailed, but not nearly for long enough. He is a head case though and I would expect he'll be put in a hospital instead of a real jail.

The guy that did this is a serious nutjob........arrogant, privilaged and narcissistic to the core with an overly developed sense of self-entitlement.

People like him have no remorse for their actions and will simply get even worse after festering in jail for a while as he probaly believes that prison is only for the poor peons of society or those who he considers underlings to his social class that have little or no money.

The Honda girl that killed those students on the highway is cut from the same piece of society's snobby fabric and no better than this murderer. The way the system here has dealt with these types of people that have perpetrated such serious crimes, despite the crimes being so publicly and widely reported, is shameful and just goes to show how discriminatory society and the law is here.

If this spoilt little brat was suffering seizures what the hell was he doing driving a car anyway and he had a valid driving licence you can't make this stuff up can ya.

"Seizures" my arse. Just lies to try and slither out of it as much as possible like the worm he is. The psychological mumbo-jumbo BS that people claim just takes the piss. Truth is, he's a murderer and was in full control of himself whilst afterwards has shown (with his family) being adept at manipulating the discrimatory system here to be biased in his favour because of his family elitist money crap. He just was worried about losing 'face' infront of people at the incident scene he considers lower than himself and did what he did because he thought it would put everyone in their place and show his power plus he thought he would get away with it, which he pretty much has.

Just wait for the news story in ten years time about the Red Bull kid getting community service and a fine from the Supreme Court of LoS (lol these cases go so far up the court system) for killing that cop in BBK because he was "emotionally distressed" at the time (or is suddenly diagnosed with epilepsy) and not in control of himself when took his Lambo for a spin in the middle of the night.........ppppleeeease!

All of these infamous cases are nothing more that beligerent rich spoilt brats that care for nothing and think the can do anything to anyone. If Thailand wants to create a fairer society (which it looks like at the moment they don't) then hauling in these rich kids and making an example of them would go a long way to that end.
