Leasing a house in thai ownership

Post by mortified »

I bought and paid for a house which was transferred into the name of my thai partner. We went through a thai wedding a few months ago but we have not formalised the marriage via embassies etc so I assume we're not "legally" married. We do plan to do this though.

I wanted to lease back the house from her and she is happy with that but the HH Land office said there has to be a period of at least one month between purchase and creation of a lease. Then I was told elsewhere the lease could be done the same day as the transfer.

I have now read on here that a husband cannot lease from a wife.

Has anyone done this with any advice or experiences they could pass on ??
Thx.

My advice ..

.. don't expect to get accurate information from anonymous posters in a discussion forum. You have no idea of their expertise nor their motivation.

Get a list of recommended attorneys from your embassy and make an appoint with one for a consultation. That attorney can probably draw up the lease as well.

I’ve no idea of the actual legality of this, (and no legal expertise or motivation either!) but it has just occurred to me, as I understand things, that you own half of anything that you both own as a married couple, so it seems to me that you would be leasing half of the house off yourself!
