Your options are basically this; you get a non-immigrant 'O' visa on the basis of marriage to a Thai in your own country, this can be either a single entry or a multiple entry. the single entry will give you 90 days, the multiple will give you a maximum of 450 days with hops out of Thailand to a neighbouring country every 90 days. To make your stay in Thailand as permanent as it can be in your situation you will have to apply for an extension to the non-immigrant 'O' visa when you are in Thailand - there is an immigration office in Hua Hin where you can do this. To qualify for the extension you have to prove to the immigration officer that the marital income is at least 40,000 baht per month, and this can be your income, your wife's or a combination, and it can be money earned overseas (for example interest on a savings account in your country) as long as it is verified by your Embassy. It is normally advised to do this when you have a couple of months left on the validity of your visa (it says on it 'Valid until xx/xx/xxxx'). You will obviously have to produce original and copies of passport and relevant documents at immigration, plus the paperwork relevant to your financial standing. Finally this will cost the princely sum of 1900 baht. If successful you will have to report to the immigration office every 90 days until 1 year is up, when you apply again for the extension, going through the same process.
The only other option is to find a job in Thailand and get a work permit, but i will leave others to explain that as I have no knowledge of the process. Once you turn 50 you also have the option of a retirement extension, similar to the marriage one, but the financial requirements are much higher for some bizarre reason. However the retirement visa extension does also allow you to show a lump sum in a Thai bank as proof of sufficient funds, which i believe is currently 800,000 baht, and there is also a combination option with any income. Again i will let others more au fait with that explain it fully, plus by the time you are 50 it will undoubtedly have changed again!
There are plenty of threads on these subjects though, so i suggest you look in the Legal, Visa, Finances & Employment sub forum (which your post is in) to find out more. Incidentally your wife is wrong unless she has some very high powered connections in immigration! :shock:

thanks for the info mate....I might try a swing through Laos then.

Its been a looooooong time since I was there last...can y get visa on arrival at the airport in Vientiane or do you have to get one before travelling? Last time I was there I went via the land crossing so am a bit out of touch on this....anyone know?

From my end, there's a PS to this thread and that's to say sorry.
As I managed to get extremely inebriated all weekend, Penang went out of the window and I went to Ranong/Burma this morning instead, so I can't update on Penang's mindset on Tourist Visas.
Anyway, although a long journey, Ranong Imm were as friendly as always. Unfortunately, the passport has got a "2" circled by this month's 30 day run and the lovely lady was good enough to tell me that I could only get one more within the 6 month period which started last month.
I assured her that I would not get tiddly and lazy again and would go to Penang for a proper visa in February. She just laughed.
Good Imm people down there, but I'm going to keep that last 30 day run up my sleeve in case I have a problem in Penang next month :cheers:

Seriously though, I don't think you'll have a problem as WL has said.
As long as you're married to a Thai and the two of you have a combined income of over 40k per month, you can extend your Non Imm visa as infinitum.
The 65k a month is for a retirement extension and you've got be over 50 years old.

Sorry, missed your query.
First off, I'd be very surprised if Penang will issue another TV. However, the agent has said come on down with proof of income. Now one of the reasons Penang are getting difficult with the TVs is to try and wheedle out people who are working illegally. Maybe the agent reckons that your friend could get another TV if he's able to prove that he can support himself without work? Then again, the agent may also reckon that he can get your friend a Non Imm O visa as he's over retirement age. That would be my best guess on the Penang situation. Of course, he could still go there and if he dosn't get any sort of visa he can come back in on 30 days at the border, but it is a long way to go.
As I mentioned before, the fact that your friend dosn't have 65k income shouldn't matter for a visa. That amount only comes into play when you're extending a Non O on the basis of retirement within Thailand.
What isn't clear yet is whether people will be able to get a TV in Penang after they've gone elsewhere to get one - for instance Vientiane. After being red carded in Penang, others are getting single and even double entry TV from Vientiane, so that appears the best place to go for a TV now.
As you've advised, it might be best for your friend to go to Ranong and get 30 days - maybe even two of them - and wait to see what's happening with others in a month or two. However it turns out, I wouldn't get your friend to do the 3 30 day runs and then try Vientiane or Penang. If the visa's refused, he may well have trouble getting back into Thailand, although I believe Imm can issue an emergency 7 day entry in situations like this, but you are taking a big risk.
Does your friend have the tel number or email address of the Penang agents? He could try and get clarification of why they were asking for proof of income that way. If he hasn't got them, I've got the email address of NJ Books on Chulia Street. They're very experienced and might be able to shed some light on the issue. If you want that, let me know.
